Terms of Service
Welcome to MyPoliticalManager, your complete on-line resource for managing your political campaign and public office. MyPoliticalManager host several websites as part of the Service, including
www.mypoliticalmanager.com and www.mypoliticalsoftware.com.
MyPoliticalManager and its licensors grant you a personal, non-exclusive, non-transferable right to use the Service solely for your own internal campaign and/or public office purposes. All rights not expressly granted to you are reserved by MyPoliticalManager. While using the Service, you are permitted to store, manipulate, analyze, reformat, print, and display the content made available through the Service only for your personal use. Unauthorized use or resale of the Service is expressly prohibited. You shall not copy, license, sell, transfer, make available, distribute, or assign your right to use the Service or the content to any third party.
Charges and Payment of Fees
You will pay all fees or charges to your account according to the billing terms in effect at the time a fee or charge is due. You must provide MyPoliticalManager with valid a credit card number when you sign up for the Service. MyPoliticalManager will automatically bill your credit card in advance for use of the Service as follows: (a) every month for monthly subscriptions, (b) quarterly or annually, at our discretion, for annual subscriptions. The charge for subscriptions will be equal to the total number of member accounts multiplied by the then-current fee. Charges for other services will be billed at the fees posted at the time such services are requested. MyPoliticalManager reserves the right to change the fees, applicable charges and usage policies and to introduce new charges at any time. We will use reasonable efforts to keep the fee schedule posted on this site current, and give you at least 10 days notice of a change by e-mail. If you believe that you have been incorrectly billed by MyPoliticalManager, you must contact us in writing within 30 days of the date you receive your credit card bill for your claim to be reviewed for a potential adjustment or credit.
Non-Payment
MyPoliticalManager reserves the right to suspend or terminate these Terms and your access to the Service if your account becomes delinquent. Delinquent accounts are subject to interest of 1.5% per month on any outstanding balance, or the maximum permitted by law, if less, plus all expenses of collection. If you or MyPoliticalManager terminates your use of Service, you will be obligated to pay the balance due on your account computed according to the Charges and Payment of Fees section above. You agree that MyPoliticalManager may charge unpaid fees to your credit card or otherwise bill you for unpaid fees.
Third Party Interaction
In your use of the Service, you may communicate with, purchase goods and/or services from, or participate in promotions of advertisers or sponsors showing their goods or services through the Service. Your interaction with these third parties is at your own risk, and is solely between you and the third-party. MyPoliticalManager has no liability, obligation or responsibility for any interaction between you and any third-party.
Links to Third Party Sites
MyPoliticalManager does not endorse any sites on the Internet which are linked through the Service. MyPoliticalManager is providing these links to you only as a matter of convenience, and in no event will MyPoliticalManager be responsible for any content, products, or other materials on or available from third-party sites.
User Account
A user account is required to access the Service and may be accessed and used only by those authorized individuals who are registered with MyPoliticalManager. To open a user account, you must complete the registration process by providing MyPoliticalManager with current, complete and accurate information as prompted by the registration form. This information includes your legal name, street address, e-mail address, and name and telephone number of an authorized billing contact. You agree to update this information within fifteen (15) days of any change to it. If the contact information you have provided is false or fraudulent, MyPoliticalManager reserves the right to terminate your access to the Service in addition to any other legal remedies. You agree to submit accurate, current and complete information, and keep it updated. Should MyPoliticalManager suspect that such information is untrue, inaccurate, not current or incomplete, MyPoliticalManager has the right to suspend or terminate your use of the Service. You must choose a personal, non-transferable password. You are responsible for maintaining the confidentiality of your password. User accounts cannot be shared or used by more than one individual.
User Responsibilities
You are solely responsible for any and all activities that occur under your account and ensuring that you exit or log-off from your account at the end of each session of use. You will notify MyPoliticalManager immediately regarding any unauthorized use of your password or account or any other breach of security that is known or suspected by you. MyPoliticalManager shall not be responsible for any unauthorized access to, or alteration of, your transmissions of data, any material, information or data sent or received (regardless of whether the data is actually received by MyPoliticalManager), any transactions entered into through the Service, or any failure by you to abide by these Terms.
Use, Storage and Other Limitations
MyPoliticalManager reserves the right to establish or modify general practices and limits concerning use of the Service, for example, we may limit the maximum number of days that your content will be retained by the Service and the maximum disk space that will be allotted on our servers for your account. We will use reasonable efforts to notify you when your storage reaches approximately 90% of the maximum, but you are responsible for staying below the maximum and for any additional storage charges that apply if you exceed the maximum.
User Conduct
You agree to abide by all applicable laws and regulations in connection with your use of the Service. In addition, you agree not to use the Service or information from the Service to: (a) send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise; (b) harvest, collect, gather or assemble information or data regarding other users of the Service, including e-mail addresses, without their consent; (c) transmit through or post on the Service unlawful, harassing, libelous, abusive, harassing, tortious, defamatory, threatening, harmful, invasive of another's privacy, vulgar, obscene or otherwise objectionable material of any kind or nature; (d) transmit any material that may infringe the intellectual property rights or other rights of third parties, including trademark, copyright or right of publicity; (e) transmit any material that contains software viruses or other harmful or deleterious computer code, files or programs such as trojan horses, worms, time bombs or cancelbots; (f) interfere with or disrupt servers or networks connected to the Service or violate the regulations, policies or procedures of such networks; (g) attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through password mining or any other means; or (h) harass or interfere with another user's use and enjoyment of the Service.
Termination/Reduction in Service Level
For monthly, quarterly or annual subscriptions, these Terms are automatically renewable monthly, quarterly or annually, respectively, unless either party requests termination or a change in service level. Either party may terminate these Terms or reduce the level of service by notifying the other party in writing at least thirty (30) days in advance of the termination date. You will be billed at your current level for the period from the date a change to your Service level is initiated up to and including the date thirty (30) days following the date you initiated the termination/reduction at the service level prior to such termination/reduction. For annual subscriptions, these Terms commence upon the Start Date (as set forth in the Order Form), are non-cancelable during the term, and, unless terminated for cause by MyPoliticalManager as set forth below, continue for the Initial Term set forth in the Order Form. These Terms then will automatically renew for subsequent one (1) year terms at MyPoliticalManager's then-current fees unless one party provides the other with written notice of its intent not to renew at least thirty (30) days prior to the end of the then-current term.
Termination for Cause
Any unauthorized access, use, copying, disclosure, distribution, or sublicensing by you or with your aid or consent, of the Service its content or any related methods, algorithms, techniques, or processes will be deemed a material breach of these Terms. MyPoliticalManager in its sole discretion, may terminate your password, account, or use of the Service and remove and discard any data you have stored on the Site if you breach or otherwise fail to comply with these Terms. Upon termination of an account, your right to use the Service immediately ceases, and MyPoliticalManager shall have no obligation, to maintain any data stored in your account or to forward any data to you or any third party.
Privacy Policy
MyPoliticalManager holds your privacy in the highest regard. We aggregate user statistics for our own use. We will take reasonable measure not to disclose information about you or your processing to any other party, except when we believe in good faith that such action is necessary to (a) comply with the law or legal process; (b) to enforce these Terms; (c) to respond to claims that any content violates the right of third parties; or (d) to protect the legitimate interests of MyPoliticalManager or other's. Our privacy policy is available here, and contains additional terms and conditions that are binding on you. MyPoliticalManager reserves the right to change its privacy policy at any time.
Proprietary Rights
Except for the licenses granted herein, you have no right, title or interest in or to MyPoliticalManager, the Service or any content of MyPoliticalManager or its licensors, including, without limitation, documentation, stories, articles, text, images, and other multimedia data and all such right, title and interest shall remain exclusively with MyPoliticalManager and its licensors, as applicable. MyPoliticalManager and/or other MyPoliticalManager products and services referenced herein are either trademarks or registered trademarks of MyPoliticalManager. The names of other companies and products mentioned herein may be the trademarks of their respective owners. You shall not create Internet "links" to the Service or "frame" or "mirror" any Content contained on, or accessible from, the Service on any other server or Internet-based device.
Indemnity
You agree to indemnify, defend and hold MyPoliticalManager and its subsidiaries, suppliers, contractors and affiliates and their officers, directors, agents and employees and contractors harmless from any claim, demand, action, cost and expense, including reasonable attorneys' fees, made by any third party for any reason, including but not limited to those claims arising out of your: (i) use of the Service; (ii) breach of these Terms; and (iii) violation of any law or the rights of any third parties
Disclaimer of Warranties and Liabilities Limitation
MyPoliticalManager, Inc. cannot replace the knowledge required of local, state and federal law. Having such knowledge is fully your responsibility. Many sources of information can be linked to from our Service but it is your sole responsibility to do so. Likewise, if additional legal and compliance information is needed, it is your responsibility to locate and understand such information independent of MyPoliticalManager, Inc.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS. IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, (A) ANY WARRANTIES CONCERING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF THE SITE OR SERVICE AND (B) WARRANTIES OF TITLE OR NONINFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SYSTEM INTEGRATION, ACCURACY OF DATA, OR QUIET ENJOYMENT.
YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE AND COMPLETE RISK. NEITHER MyPoliticalManager, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, NOR ITS CONTRACTORS OR LICENSORS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, NOR DO THEY WARRANT CONTINUOUS, UNINTERRUPTED, ACCURATE, OR SECURE ACCESS TO THE SERVICE.
THIS DISCLAIMER APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. PLEASE NOTE THAT SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, OR THE DISCLAIMERS PROVIDED FOR HERE, SO SOME OF THE ABOVE EXCLUSIONS AND DISCLAIMERS MAY NOT APPLY TO YOU.
UNDER NO CIRCUMSTANCES SHALL MyPoliticalManager, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS SUPPLIERS, CONTRACTORS, OR ANYONE ELSE ACTING THROUGH OR ON MyPoliticalManager'S BEHALF, INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING THE SERVICE, BE LIABLE FOR ANY CLAIMS, CAUSE OF ACTION, DIRECT, INDIRECT, SPECIAL OR CONSEQUENTIAL, TREBLED, OR PUNITIVE DAMAGES THAT RESULT OR ARE ALLEGED TO HAVE RESULTED FROM THE USE OR INABILITY TO USE THE SERVICE OR THAT RESULTS FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, DELAYS, FAILURE OF PERFORMANCE, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO MyPoliticalManager'S RECORDS, PROGRAMS OR SERVICES, WHETHER OR NOT LIMITED TO ACTS OF GOD.
IN NO EVENT WILL MyPoliticalManager HAVE ANY LIABILITY FOR ANY ACTION OR INACTION BY IT WITH RESPECT TO THE SERVICE. IN ALL EVENTS, MyPoliticalManager'S LIABILITY HEREUNDER SHALL NOT UNDER ANY CIRUMSTANCES EXCEED THE AMOUNT OF FEES ACTUALLY RECEIVED BY MyPoliticalManager FROM YOU IN THE ONE MONTH PERIOD PRIOR TO THE INCIDENT OR OCCURRENCE GIVING RISE TO AN ALLEGED LIABILITY.
Submissions
MyPoliticalManager alone will own all right, title and interest, including all related intellectual property rights, to any suggestions, ideas, feedback, recommendations, or other information provided by you relating to the Service ("Submissions") and you agree to assign such Submissions to MyPoliticalManager free of charge. MyPoliticalManager may use such Submissions as it deems fit in its sole discretion.
Notice
MyPoliticalManager may give notice by means of a general notice on the Service or by electronic mail to your e-mail address on record in MyPoliticalManager's account information. You may give notice to MyPoliticalManager (such notice shall be deemed given when received by MyPoliticalManager) at any time by any of the following: letter sent by confirmed facsimile to MyPoliticalManager at the following fax number: (800) 813-0948; letter delivered by nationally recognized overnight delivery service or first class postage prepaid mail to MyPoliticalManager at the following address: MyPoliticalManager, 333 Bridgewater Dr., Savannah, GA 31419 or to this e-mail address: info@mypoliticalmanager.com.
Modification to Terms
MyPoliticalManager reserves the right to change the terms and conditions of these Terms or its policies relating to the Service at any time and shall use reasonable efforts to notify you by a general notice on the Service or sending an e-mail to you. You are responsible for regularly reviewing these Terms. Continued use of the Service after any changes shall constitute your consent to changes.
Beneficiaries
The rights and limitations in these Terms are also for the benefit of MyPoliticalManager's licensors each of whom shall have the right to enforce its rights hereunder directly and on its own behalf.

General
These Terms will be governed by Georgia law and controlling United States federal law, without regard to the choice or conflicts of law provisions of any jurisdiction. You shall bring all disputes, actions, claims, or causes of action related to these Terms or in connection with the Service only in the federal and state courts located in Atlanta, Georgia. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the invalid or unenforceable provision(s), with all other provisions remaining in full force and effect. No joint venture, partnership, employment, or agency relationship exists between you and MyPoliticalManager as a result of these Terms or use of the Service. The failure of MyPoliticalManager to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by MyPoliticalManager in writing. This is the entire agreement between you and MyPoliticalManager and the subject matter contained herein.
